Tempting fate

After a recent announcement of two new products LPhotos and LTunes (which carry a strongLsongs Lphotoresembalance to ITunes and IPhoto based on screenshots), people are wondering what the hell is wrong with this company.  While Apple hasn’t responded (at least publicly) Lindows Inc has really jumped out of the frying pan and into the fire. 

 

Obviously they must think the have something here, otherwise I can’t imagine them doing the same stupid thing that they just tried and failed to do to Microsoft, but geez…these guys really like tempting fate.

Lindow's infinges trademark. The typefaces in those logos may infringe "trade dress" of apple products, but legally, according to my lawyer the look and feel of iphoto doesn't exist, therefore it cannot be protected, infringed, or anything like that. Remember the years of Apple suing MS for ripping off windows from MacOS? That was the same thing. Apple loses. So they'll change the fonts and maybe the names, but it can work exactly the same. You can't legally protect the music explorer + playlist manager + status bar with VCR controls UI. It is not property.

Whether Lindows has won or lost its battles, it has always been able to get lots and lots of publicity. LPhoto just continues this trend. Here it is getting a right-up in a macintosh blog, possibly introducing some people to the company when they otherwise would not have heard of it.

After looking at LPhoto, I think the Lindows guys are gonna get an ass whupping and they desrve it to for such a blatant copy of iPhoto. Someone ought to tell them that the are part of the open source community not the open to copy anything community.
