iPod nano suit goes international

nanoThe class action suit that has been filed against Apple on behalf of iPod nano owners has reached the UK and Mexico. In brief, the suit claims that a design flaw allows the screen to become severely scratched after being subjected to normal use.

Steve Berman, the lead attorney in both the American and international cases, released this statement:

"It seems that wherever the nano is sold, problems with the defective design soon follow. The far-reaching response also reveals that this is not just a small problem or a bad batch of nano’s, but a defect in the overall design that should have been rectified prior to the release."

Ok, I can understand that it kind of stinks that your brand new iPod got scratched up, but come on. Demanding a cut of the nano's sales revenue is a wee bit extreme, don't you think? Just get yourself a can of Brasso and a case.

oh please. wah wah wah. My brand new Lexus got a scratch so I'm suing the car manufacturer. Give me a flippin' break. If your Xbox got a scratch would you sue Microsoft? How about a scratch on you flip phone? If it's scratched and you're unhappy TAKE THE DAMNED THING BACK to the store and get a refund. Then go buy something else but quit trying to suck money out of Apple because you (or your smarmy lawyer) sees an opportunity to make a quick, easy buck. Here's another example: I just got a notice from Netflix that they've been sued by some yutz in California because he didn't get "unlimited rentals within one day or ordering." Hmm. I never saw anything like that on their website but I've been know not to read the fine print. This is just another nuisance lawsuit because somebody is cranky and feeling put upon. Seriously. If it is that big a deal just take it back. I've been using apple products for 25 years. In all that time I had ONE problem ... a cd drive quit on me. I had applecare and they sent a tech 125 miles one way to fix it. Now THAT's customer service.

uhmmmm... i've seen the nano a friend of mine owns, she treat it carefull, always keep it in a ipod sock and almost never use it. well, the display is scratched almost to uselessny (does this word actually exist? ;P) there's absolutely something wrong with the nanos. as there was something wrong with the paint on my titanium powerbook and on the keyboard touching the lcd display and leaving marks. apple creates amazing products, but they quality assurance process has something definetevely wrong. now answer this, if it was someone else selling products with the same defects, what would have been your answer? are you really sure that it would still be "ehi, get yourself a case/put something on your keyboard so it doesn't touch the screen/put your notebook in a vault so it doesn't get scratched"? m

I was at Fry's the other day. Their display nano was horribly scratched, and it just sits there on its tether! Seems to me there may be something to the complaints. I'm not sure as a class action suit is REALLY the answer to this, but if it gets Apple to spend a bit more time on QC I guess that's OK.

Has anybody heard of the iPod video display scratching? I haven't. And if they're not, maybe Apple did get a bad batch of screens from the vendor, as Apple explained in the beginning.

Isn't the real issue simply that black shows scratches more than white does? Especially since Apple uses the same clear Lexan outer case for both black and white iPods. This may be a design flaw, but it is hardly a defect.

I don't think it's so bad that Apple gets sued over this. Hopefully they will FINALLY start to put more attention on quality control. I bought two Apple computers so far. A Performa in the 90s and an iBook last year. Both had manufacturing flaws which needed to get fixed. A monitor cable was faulty with most Performas, and now there was the battery recall for iBooks. Seems like Apple puts a lot of money into the design of their products, but certainly not in the quality control in their Asian plants.
