The Unofficial Apple Weblog (TUAW)

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, and intending to be legally bound, the undersigned (“I”, “me”, “my”) (and his/her parent(s) or legal guardian(s), if applicable) grant Weblogs Inc, its parents, subsidiaries, affiliates, successors, assigns, licensees and authorized agents (“Weblogs”) the right to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and my voluntarily submitted costume photo (“Images”), or any portion thereof, in the program or feature called  “TUAW Halloween Gallery 2007” or any other program or feature for Weblogs (“Program”) , in any manner, in any and all media whether known or invented later including in connection with any of Weblogs products, services, or affiliated Internet sites, whether online or offline, worldwide, in perpetuity, including in all merchandising, advertising, promotion or publicity for the Program or Weblogs, and by any mode of delivery.  Weblogs is not obligated to include the Images in the Program or in any program, and is not obligated to produce the Program.

I represent that (i) I am the photographer of the Images, and (ii) that I have obtained permission from all third-parties in any group shown in the Images.

I agree to release and hold harmless Weblogs from and against any and all claims that may be made against Weblogs based on the Submission or Weblog’s use thereof.  In the event of a dispute, I agree that I shall be limited to my remedies at law, and in no event shall I have the right to enjoin or prevent the production, distribution, exhibition or other exploitation of the Program or any other programs, or the advertising, promotion and publicity related to the Program or any other programs.

I understand that Weblogs is not obligated to include the Submission in the Program/ Contest and is not obligated to produce the Program/ Contest.

I understand that if I am between the ages of thirteen (13) and seventeen (17) I MUST PROVIDE MY PARENT’S EMAIL ADDRESS so that they may be notified of my participation in the Program.

I warrant and represent that I agree to be bound by all the terms and conditions of the Official Rules listed on the Program/ Contest website regarding participation in this Program/ Contest, and those terms and conditions are made part of this Agreement and are incorporated herein by this reference.
