iPod owners actually sue Apple
File this one under "completely ridiculous." iPod nano owners have filed a class action suit against Apple Computer over the nano's susceptibility to scratches. Is it just me, or is this like suing Kodak because your photos got fingerprints on them? Now hold on to your hats, because here's where it gets really silly. The owners named in the suit are demanding that customers get their money back (because the thing got a scratch on it), as well as a share of Apple’s profits on iPop nano sales. Because it got scratched.I don't know whether to laugh my head off or be ashamed of the blatant display of greed. Come on, people. Your Mp3 player got scratched. Lighten up.

I got my nano and it was already scratched out of the packaging... even with all that silly clear plastic stuff all over it. I just dealt with it...but now it just plain stopped working...however they are replacing it for me. I was a little miffed when they came out with the NANO and I liked it but then like 2 months later they come out with the video unit and for $50 more I could have had 6500 more songs..and video. But that's again like buying a car then complaining that the newer model is better. I was just miffed because I am usually up on this techy stuff..and that one got by under the radar...

I bought the iPod because it is prepossessing, appealing, gorgeous, delightful, winsome, and magnificent. Not to mention I have a season and a half of lost and a dozen other shows on it along with 1,500 songs. I can't bring myself to leave it anywhere, this thing goes more places than my Visa card! And I also did not do anything to prevent scratches. I keep it in my pocket, lay it in the floor of my car when I am driving and it sits on my desk. If I has used the little sleave Apple provided or purchased a third party case it would be a lot better that it is. But again, this is my fault. I would never sue Apple for somethis this trivial.

I juggled a minimum-wage job with full time studies for months to be able to afford an mp3 player with replacable battery, so I could effectively have it for life. 24 hours after purchasing it I can't stand to look at the thing because - and here's my crime - I put it in the same pocket as my phone and walked down a hill. The phone looks fine (as would any normal piece of equipment) but the *black* video iPod is scratched to hell! To the degree that it not only looks TERRIBLE but under certain lights the scratches on the screen make it illegible. If the plastic on the agent 18 shield doesn't scrath (as easily) then why not use that plastic when making the ipod? Cynical me thinks this is just a play to sell more accessories and we're all falling for it!

Then YES to the lawsuit for replacement or refund only. Also remember that Apple is in business to make money not provide a way for the world to hear music or watch videos. Bottom line!!!

Momentarily, assume that even Apple customers care about product quality, and leave off the Win-dohs people. Secondly, assume the US became so wealthy BECAUSE we care for the quality of a product, and drop the bourgeois bashing. Thirdly, let's compare apples to apples, rather than cars. The brushed aluminum and plastic case of my creative slim has survived two years of mountainbiking with a small dent, and no scratches on the aluminum. The last BIKE is in pieces awaiting the replacement. (Specialized covers lifetime on mountain bikes! Apple can't cover a pod?) Why hasn't my nano managed to from home to work in my pocket without be scratched to hell?

The last time I was in my local Apple store to put my paws on the latest widgets, I picked up a nano. The screen looked horrible. It looked like a cheap toy that some three year old had been chewing on. Yes, I'm sure it had taken a lot of abuse, being a store model, but the regular ipods did not display the same level of rampant scratchiness. I think Apple has released a defective product and I hope the class action case is successful.

The aesthetic plastics used in Apple products are high-quality optical-grade polymers. They are the same type used in eyeglass and sunglass manufacture. Those who wear glasses will know just how easy it is to be careless and accidentally scratch a lens, even if it happens to be scratch-resistant. That said, the actual polymer chosen for the nano is softer than previous polymers used by Apple because of the aesthetics and other concerns, such as shock absorbing. The choice to use this particular plastic was a painstaking one, as noted by Jonathan Ive in interviews, but an informed one. Apple put initial aesthetics and technical concerns above scratch resistance, and is justified in doing so. Had they used a harder polymer, such as the one used on the G4 Cube, there would be a greater chance of the case actually shattering under a light impact. I hope that, if this case does actually go to court, Apple notes this. Which would be worse, some scratches on your nano's face, or bits of the face chipping off at the corners? This, to me, is an example of an uninformed (or worse, misinformed) public being led by litigious attorneys with their eyes on the dollars and not sense.

They reside in states that are very pro-class-action-suit. Class action suits are money-makers for law firms, nothing more.
