Psystar shuts down
After Apple's sweeping permanent injunction, Psystar has officially ceased operations. The company's CEO Rudy Pedraza told the Dow Jones Newswire last night that he is "shutting things down immediately." The company has also released its eight employees, and shuttered its website last night. The actions came after Apple's permanent injunction against Psystar earlier this week, which gave Psystar until December 31st to stop selling its Mac clones. The clones violated Apple's End User License Agreement for Mac OS X, which expressly forbids use of the operating system on non-Apple hardware.
This also marks the end of Psystar's Rebel EFI software, which had been Psystar's only viable product since early December. Many Psystar watchers doubted if Psystar would continue to sell it.
Psystar first started selling its computers in April 2008, and Apple filed a lawsuit soon after in July 2008. The company was granted a motion against Psystar to stop selling its computers, preinstalled with Mac OS X, by Judge William Alsup in November. Psystar paid Apple a $2.7 million settlement earlier this month, which included $1,337,500 in copyright infringement damages.

Update: The Psystar website appears to be back online at the moment, but isn't currently selling any Mac clones or any licenses to Rebel EFI, but Rebel EFI is listed as "Out of Stock."

Control and profit at all costs is Apple's M.O. Should we really be surprised that Apple sues people if they don't want to be controlled or don't like to finance triple digit percent margins? Even some who are willing to pay up don't like foreign workers to be treated like cattle.
BTW, Good Riddance to Psystar, OSx86 pirate and pathetic excuse for a company!
Does this mean that I can now freely distribute Psystar's Rebel EFI software (which I did NOT pay for) FOC to my mates who want to run OSX on their WinPCs?

December 18 2009 at 10:54 PM Report abuse Permalink rate up rate down ReplySo did we ever figure out who was funding them in the first place? There seemed to be a lot of talk about a third party financier, but never heard anything more about it.

December 18 2009 at 7:48 PM Report abuse Permalink rate up rate down ReplyEight people who were working for a company whose founders knew their business was illegal. Be mad at the Psystar bosses, not Apple.

lol what 8 people lost their jobs working for a company engaged in illegal activity. I suggest we have a christmas whip-round for those employees working for the Mexican drug baron who were caught last week and will spend Christmas in jail. Dumbest comment I've read all year!!
For 2010 can TUAW include some sort of intelligence test before anyone's allowed to post!!
Actually, Psystar hasn't paid anyone anything, because it has no money. It merely *agreed* to pay Apple that amount, barring it somehow making a successful appeal. I'm not really sure how it plans to do that, though Kamara told me that it wouldn't be charging Psystar anything unless it won.
December 18 2009 at 7:04 PM Report abuse Permalink rate up rate down ReplyDamn, that happened fast... saw it coming, but I expected Psystar to shut their doors with a louder slam than that!
December 18 2009 at 6:23 PM Report abuse Permalink rate up rate down Replywhy, they lost. they knew it. they likely knew it before they started but figured they might get lucky with a dumb judge.
and forget the EULA. they violated copyright and the DMCA. even if the EULA was struck down they were still done.
also, Rebel had to go as well. it's in the injunction under banning all activities that assist other in installing Mac OS X
the real win for Apple other than the strong precedent for other lawsuits and suiting down all sites that provide info and software for making HackMacs is that the injunction is for all current and future OS software. and apparently is worded as such that even the Iphone OS is covered. so Psystar can't try this again in a couple of versions. and the case re: Snow Leopard will be done before it starts
