Psystar files one more appeal in court
They're like cockroaches! Psystar is back yet again, this time filing yet another appeal against yet another injunction by Apple telling them that they can no longer sell their unauthorized OS X PCs. As previously reported, they've been on Apple's bad legal side for a long time, and the last injunction had them down to selling t-shirts. Now, they've got only one copy left of their Rebel EFI product, and it's in the hands of the lawyers trying to keep the case open. Just as they promised, they're filing one more appeal against the far-reaching injunction to try and keep the case open...I'm as big a fan of Psystar as the next guy, and despite their complete and total losses in court, I almost want to see them keep going in a car-crash sort of way. But at this point, it's pointless -- Apple has won in every conceivable way, and Psystar is just wasting their own money and the courts' time by carrying on. It's their right to do so, of course, but this likely means that the next judge to look at the case will just lay the smack down that much harder.

talking around the elephant in the room-hackintosh/ opening up OS X- until then we are all cock roach? or are we OS devs working for free to advance these products?

Apple is more likely to prefer bankruptcy. Aside from not treating their own customers like would be criminals, Apple could benefit from treating their own Chinese employees like civilized human beings instead of like expendable cattle.
January 19 2010 at 8:32 PM Report abuse Permalink rate up rate down ReplyIf you are talking about factory staff, they are not employed by Apple. Apple does however employe a number of technitions and marketing folks in the PRC which I have never heard issues of.
cockroaches is a bit of a harsh comment, since most of your staff advocate jailbreaking, which is JUST as against SLA as psystar's activity Takes one to know one and all that.
Having said that, I do think they should just give it up. Apple hire super alien lawyers from space, and psystar have as much of a chance of winning this legal battle as Lionel Hutz.
As much as it pains me to say it, Apple really are within their rights to do this as well, since their business model relies on the sale of hardware as well as software. If they choose to tell you that you can't use their software on other hardware and you continue to buy their stuff, then there is no right in complaining.
oh, come on! you might question their business practices (I do) but "cockroaches"? that's just a bit over the top.

After all, they stole from the Hackintosh scene (and later added insult to injury as well), made pirated copies of OS X itself (which they lied about making), and are mostly getting legal help from Microsoft and Dell, among others. They are trying to eke out an existence on other people's stuff and the big $$$ pouring into their operation from their "anonymous" supporters is akin to the high reproductive rate that can make an exterminator's job challenging. The shoe fits, so it should be worn, although this particular shoe is not for the faint of heart.

Cockroaches clean up discarded waste, keeping our environment clean at a microscopular level. They are like little self-charging environmentally friendly, Roombas that don't break down.
Psystar could be more likened to a Dysenteric Amoeba or Intestinal Worm. They parasitically prey off of the resources of a more impressive creature, weakening it. One Amoeba or Worm won't do much damage, but once established, they reproduce asexually and proliferate exponentially. Enough of them can take down the mightiest of beasts.
