Apple launches Headphones with Remote Replacement Program
Apple has launched a replacement program for third-generation iPod shuffle headphones with remote controls that exhibit performance problems. The symptoms of the issues, which have led to some lengthy discussions in Apple's Support Forum, include controls that are non-responsive or work intermittently, unexpected volume increase or decrease, and unexpected playing of voice feedback. The serial number ranges of the iPod shuffle with the affected headphones are xx909xxxxxx to xx952xxxxxx and xx001xxxxxx to xx004xxxxxx. A very small percentage of iPod shuffle owners have experienced the problems, according to Apple. The issue is apparently limited to headphones that were included with the 3rd gen iPod shuffle made between approximately February 2009 and February 2010. Apple also notes that any Apple earphones with built-in remote, like the ones that ship with the iPhone, are covered under this replacement program as well.
Full details on the replacement program, including how to locate your serial number and the steps to go through to obtain your new headphones, are on the Apple Headphones with Remote Replacement Program page.

It appears there is another Michael B. out there, well thank you, this Michael B. is glad to know because I have a 3rd gen iPod touch and my girlfriend has a 3rd gen iPod shuffle.
Yay new white headphones!
I almost feel sorry for the people who got that new iPod Shuffle instead of getting the last gen with its own buttons on clearance like i did.
Almost.
I just wish Apple would make a remote/microphone combo that allows you to use your own headphones.
I've snagged 2 sets of replacement headphones for 2 iPhones in the past few months as the originals just 'wore out'. Apple was totally cool about it - shipped the new ones, no charges to my card, etc. All I had to do was drop the old ones in the envelope and ship them back.

The remote and mic were not working so i got them replaced by apple free of charge. When i got the new headphones, they still didn't work. So I got a flashlight, and looked down the headphone jack. In the two years that my phone has been in my pocket, a huge chunk of lint had managed to accumulate inside the jack, blocking the connection for the remote and mic. I just got a toothpick, dug it all out and 10 mins later, everything was working perfectly.
Just try this quick fix before bothering a visit to the Apple Store
