Apple Pay, DoorDash Sued Over Subscription Charge

Apple and DoorDash are facing a class-action lawsuit filed in New York. The complaint alleges that both companies charged a user without her permission.


Kristine Divney claims Apple Pay processed a $9.99 charge for DoorDash’s DashPass service. She says she never created a DoorDash account or used Apple Pay to approve the payment. According to the filing, Divney only signed up for Caviar, a DoorDash-owned platform.

No Subscription, Yet Still Charged

Divney checked her account and found the charge in May 2025. She contacted DoorDash customer service, who confirmed she had no account with them. However, they refused to refund the amount.

To stop future charges, Divney was told she might need to cancel her credit card. Even worse, the lawsuit claims that a new card could still be charged unless she blocked DoorDash indefinitely.

More Users May Be Affected

Divney says she found other users with similar experiences. Some have shared complaints online about unexpected subscription charges. The lawsuit argues that the affected group is large enough to qualify for class-action status.


The complaint states that DoorDash and Apple Pay both have millions of active users. Many of them may not be aware of these charges. This could lead to more people joining the case.

What Happens Next?

The case is now with the Supreme Court of the State of New York. If approved as a class action, it could set a legal precedent nationwide. Similar lawsuits might appear in other states.

So far, Apple and DoorDash have not commented publicly.
