TUAW is pleased to bring you a gallery of the complete iPhone licensing agreement from the iPhone activation video earlier today. We haven't given it a full going-through yet (and frankly, we're not lawyers), so please let us know if you find any particularly intriguing or surprising language. It contains legalese about the terms and conditions for the iPhone software, the iTunes store and Google Maps.

...service requirements: you shall not use it by any means other than that provided by Apple...
(translation: if you wish to use the iPhone, you will be restricted to AT&T by law. Using other providers [i.e. unlocking the phone] is considered illegal by these TOS)
One more reason I won't be buying the iPhone. I think it's a great device and all, but I'll never go back to AT&T.

Its not the law that binds you its your contractual aggreement by pressing "agree" Breach of contract and breaking the law are two diffrent things... that provide diffrent levels of punishment. and im fairly certain that its not the first time in an APPLE TOS or any other companies TOS that that statement has come up.

on the new york times, progue wrote a review, and there are some photos of the camera. and also one o the interface for the camera.
check it out.
and its slow. to load amazon.com on EDGE it took him 55seconds, yahoo over two minutes.

Mossberg loves the phone and doesn't have a problem with the keyboard. His biggest complaint is EDGE.
But there is no way to cut, copy, or paste text!!! Apple, the computer that created desktop publishing forgot that!

I think I am finally dead set on getting it, but does anyone know if I loose my rollover minutes by upgrading to an iPhone plan? I think this is the last question I have left about it.

hey thanx. it took me quite a while to do it. Here's the secret for my MacBook (work on MBPs) use the 2 finger scrolling very carefully.

Will, you should keep you minutes by just adding the data plan to your bill. But ATT could be perfectly mean about it too.

At 2:56 in the video, it shows that the data plan with 1500 SMS text messages runs $20. But elsewhere it shows that 200 SMS is standard with a $10 upcharge for 1500. Which is right? 200 SMS is crap. And why no MMS? It is 2007 After all.

Isn't there a consumer protection law which states that phone companies can't prevent you from unlocking a phone? You'll have to pay the contract termination fee but I thought that companies can't stop you from unlocking although they don't have to help you do it either.

I could be mistaken, but the Table of Contents appears to be the only thing that varies from the standard iTunes Store agreement.
All of the verbiage is iTS related, and the date at the end of the document is September 12, 2006.

Henry, I also think they can't stop you from unlocking the phone. Moreover, you don't have to pay termination fee to do so. When I unlocked my phone, I just called the carrier and asked them to do it. They were pretty happy to oblige.

If you had come up with something intriguing in the TOS, that'd be something... but this is insanely useless!!
I swear I'm getting tired of reading tech news these days. OK, the iPhone is coming, but enough with useless iPhone news...

In the US, it appears that the "law" with respect to cell phone unlocking is an excemption made by the US copyright office, under provisions of the DMCA. In other words, handset makers and carriers can't use the DMCA to protect their business model by disallowing the use of the phone with other carriers. This exemption can potentially go away as exemptions are reviewed every three years, per the terms of the DMCA statute.
I don't know if EULA and TOS terms that prohibit unlocking are enforceable. That is a different matter.

The best part of this is that they charge a $175 if you cancel your contract before the two years is up. So if a 2G iPhone comes out (fairly probable) you have to pay $175 to get out of your contact to get a new one.
AT&T is currently allowing people to cancel their existing contract to get an iphone but you can bet that that won't be the case when people want to get the latest and greatest iphone.
I currently have AT&T and never sign into contracts (been with them (cingular/pacbell) for almost 10 years now) and this 2 year agreement is about the only thing I'm weary of when buying this device.

at 19: wait wait wait....
i have at&t now. won't buying an iPhone just cause me to re-commit to two more years agreement, not break my current contract, esp. if i'm just adding the unlimited data plan for 40 bucks to my existing account?
for example, if i bought my first phone in june of 2006 and buy the iPhone in 2007, that just means i have to have service with them til 2009, rather than 2008 from the first phone. i don't break my contract so much as i do "extend" it...
so when generation 2 comes out, say in june 2008, if i buy THAT phone, then my agreement will have to go til 2010.
it would be stupid of at&t to make you pay an early termination fee if you still intend to do business with them with the same amount of minutes and data and just upgrade your phone.
the $175 early termination fee would be in the event that you cancel all services with them and choose not to continue business, whereas you agreeing to "re-commit" to two more years midway through your previous agreement brings them much more money over the time of two years than $175
