iPhone Licensing Agreement

TUAW is pleased to bring you a gallery of the complete iPhone licensing agreement from the iPhone activation video earlier today. We haven't given it a full going-through yet (and frankly, we're not lawyers), so please let us know if you find any particularly intriguing or surprising language. It contains legalese about the terms and conditions for the iPhone software, the iTunes store and Google Maps.

The only thing I noticed in the agreements is that at the in the table of contents at the beginning of the AT&T one, it lists both Pre and Post-Paid Terms of Service separately. I doubt it means anything though. It looks like it's just the standard AT&T TOS

13, 26, 28 I'm not sure if there is a "law" per se, but if I remember correctly there was a court ruling stating that it was not illegal for consumers to have their phones unlocked.
There's nothing in US law stating that cell phone providers can't lock a phone or that they have to unlock it for you -although most, with the notable exception of AT&T, will, upon request.
All it says is that it's not illegal for you to have the phone unlocked if you can figure out a way to do it. It looks like Apple/AT&T has taken special measures to make that even more difficult than usual.

at anyone who thinks that it is law for cell phone providers to unlock you phones in the USA that is incorrect the iphones service is being provided by AT&T they did not make the phone the phone is Apple and the only way to unlock a phone is contact the maker of the phone that is why it takes 2 weeks to get the unlock code. since AT&T have an exclusive deal with Apple do you think that there will be a way to get the phone unlocked? NO

from someone who owns a treo and has heavy usage experience with a pocketPC (dell axim), blackberry (pearl) and the new nextel with winMobile, allow me to rant:


it's not JUST A PHONE that can play music and videos
it's a SMARTphone that can play music and videos EFFECTIVELY
ever try to play video on a Treo?
ever try to listen to music on a Treo!?
and you certainly can't do either on a blackberry!
this is the first phone to TRUELY PLAY MEDIA
especially with youtube

more than that, it represents a new era in mobile tech
3.5" MULTITOUCH SCREENS
accelerometers, ambient light sensors, proximity sensors - yea, they're in computers, laptops, etc. --- THIS IS A FREAKING PHONE!
TRUE INTERNET BROWSING (the treo/berry/win mobile web feature is laughable at best)
GOOGLE MAPS with satellite view

anyone hear about 5 way conference calling?
how about visual voicemail?

fact is, the phone isn't perfect
it's not the jesus phone
it IS the virgin mary phone
cuz from this baby right here, you're gonna see the birth of a new age in mobile devices

hope you like the analogy on that

you're gonna hand them $600 on a phone
another $36 in activation fees
and a minimum of $60 per month for service
something tells me they'll let you upgrade without the fees
you'll just have to commit to another two years from the day you get your new 2G iphone

and if that's not the case, me and you are marching to AT&T headquarters to bust some thieving corporate biotch ass

I'm an unabashed Apple FanBoy but, this iPhone mania makes us all look nuts. I get it.....it's a phone that can play video and audio. Alright already. Enough already. Please, make it stop!

I get the feeling that everyone going gaga over the iPhone is going through box after box of Kleenex. Ugh.

It's not against the law in the US, it's common practice for providers to lock you in and give you a discount on the phone, perhaps even losing money on phone itself.

I don't know about the US but here in Belgium it's against the law
to sell a phone "locked" to a provider contract!
