Just because Steve has promised to give us an SDK in February doesn't mean TUAW's own Erica Sadun is giving up on us. She's still going strong on getting more and more functionality onto the iPhone as we speak. Case in point: her new SendSong, which is updated from before to work with 1.1.1 and the latest ringtone developments.She warns that it's still pretty "flakey," but the idea is that you can click any song in your iPhone's library, and then choose to send it by email to someone else, or (and here's the kicker) automatically make it a ringtone. Give it a try, and let her know how it works. Official iPhone development may start in February, but unofficial iPhone development continues.

Just my thoughts,
I know the ringtone will work if I create a little fake m4r in the directory. Than, it will support m4a ringtones. Will the program be able to write some codes to finish this complicated process:

First of all it wouldn't be free, but even more, any apps will need to be approved by Apple and likely only installable via iTunes, so you'd NEVER see them allow an app that bypasses their rip-off ringtone system, let alone allow you to send a music file from your iPod to another device or to email.

Umm, there are a lot of people out there who produce their own music you know. A huge number on the mac in particular. Having the ability to plan someone a snippet of your song wherever you are has always been great with the iPod. Being able to then email that song to someone you meet in public is great publicity.

Your argument is too fallacy laden to properly deconstruct in a short period of time, but here are some quick observations.
First, everyone wants everything... preferably for free. Are ringtones part of the greater whole which is this universe? Yes. Do we need to get everything we want? No.
In addition, and as an aside, I have no objections to free ringtones, in fact I consider it criminal (literally) that I should have to pay twice for something I already purchased. It goes against everything I stand for.
Second, yes Erica is an amazing hacker and a very intelligent human being who the iPhone dev community owes a great debt. Its nice to see someone on a "gadget blog for once who actually knows what they are talking about.
Third, Not a single person here has suggested that the RIAA owns "all the mp3s", and I actually prefaced my original comment with a note saying that they could go suck on a lemon (metaphorically). Sweeping generalization, or poisoning the well...pick your ...uhh... poison.
Fourth, the people who are saying "we want all the free songs!" are not the same people saying "this could be illegal."
I made what I feel is a valid point that there is potential for this to be abused by sharing material that shouldnt be shared. Billy and Rowan made excellent counterpoints on how it could actually be used for good.
Bring something intelligent to the discussion please.
