Apple to Pivotal: Take the 'pod' out of Podium
Apple has issued a cease and desist letter to Pivotal, creators of Podium, a hands-free iPhone stand - namely over the use of the word "Pod" in Podium. An excerpt from the cease and desist letter provided to TUAW states that "The term POD has also been adopted and used extensively in the marketplace by consumers as an abbreviation to refer to Apple's IPOD player. The IPOD and POD marks indicate to consumers that a broad range of products, including portable electronic devices, computer software, and related goods and services bearing those marks and marks similar thereto originate from or are sponsored or endorsed by Apple."
"If you look at our product and then look up the word Podium in the dictionary, I think it becomes pretty clear where our branding inspiration came from" said Scott Baumann, president of Pivotal.
Podium (noun)
Etmyology: Latin
Date originally used: 1743 (a good 243 years before Apple was founded)
1: a low wall serving as a foundation or terrace wall: as a: one around the arena of an ancient amphitheater serving as a base for the tiers of seats b: the masonry under the stylobate of a temple
2: a dais especially for an orchestral conductor
Source: Merriam-Webster
The letter also alleges that Podium infringes on Apple's trademark because the stand mimics recent iMac models and that Pivotal's site for the product is also ripping off Apple's brand stylization. The cease and desist also covers Pivotal's currently in-development product, FlyPod. Pivotal states that the company will be seeking legal advice on the matter.

Wow.
I love you Apple, but you need to lay off the Lawyers. What, you're not innovating as much anymore, but still want to stay in the spotlight, so you come up with this crap?
As for the look and feel... you didn't win against Microsoft with that claim, why don't you stop screaming it every two seconds?
This really Irks Me I have had it with the apple greed machine that keeps attacking company's when ever an idea that they should have come up with was done better and faster by some one else pretty soon all i's in anyones advertising will be challenged then it will be the eye's in your own head as they sound the same and the average human can not discern between the apple ithingy and the actual eye at which point apple will ask that the human population be blinded to prevent confusion. Give it a rest apple you are making us all sick.

< http://www.peapodmobility.com/ > that's closer to iPod than Podium for sure.
The Apple legal team must be bored of late or something of the sort this is so ridiculous.
Well, look at the Roadtools' Podium Coolpad. It's a laptop stand, and has been around for years. I don't think Apple ever had a problem with it,but I also don't think it looks like it was ripped off from an Apple design.

Maybe the foot came before the iPod, but the iPod is far more important. Even those poor little amoeba will have to rename their "pseudopods" to fakefoot or falsefoot and be done with it.

For a company that rips stuff off all the time (see Xerox, Unix, Christian Marclay, Eminem, the Beatles, etc.) they have a lot of balls. You'd think that a company who makes it their official policy to say "Screw it" if they want something that's trademarked yet cannot come to an agreement beforehand (See Iphone) would at least chill the hell out.
To those of you defending them because they're obligated to pursue their trademarks, get real. The product is called Podium. The day that everyone in the world is getting sued for naming their product something that is 1. applicable to the design (it looks like a podium, it's called Podium. Are people really this stupid?) and 2. Using an english word that existed for LONG before their company ever did which has precisely 3 consecutive characters to do with their dumbass trademark.
Seriously. Sometimes I hate this company.
That's funny because it's not proper to say iTouch either does that mean I'm wrong if iTouch myself?
Apple, podium is pronounced po-dium, not pod-ium.
Just because a word contains the string "pod" doesn't mean they're pronounced together. English is funny like that. If only it was California's native language (or even the U.S.A's for that matter)...
Apple... pshhh... whaaaattt thhhhheee heck! they cant go n own every single *^&@#$ word that has "pod" in it... its freakin ridonkulous!
