The battle escalates: Nokia files patent infringement complaint against Apple

Finnish mobile device manufacturer Nokia today filed a complaint with the U.S. International Trade Commission (ITC), alleging that Apple is infringing on seven distinct Nokia patents in its iPhone, iPod, and Mac product lines.

Nokia says that Apple has used its patented technology to create key product features in terms of cameras, antennas, power management, and user interface. The technologies allow Nokia to create small devices, deliver longer battery life, lower their manufacturing costs, and provide better user experiences.

The complaint isn't the first shot in the war between the two mobile phone giants. In October, Nokia sued Apple over alleged infringement on GSM and wireless LAN patents. This month, Apple countersued Nokia, charging that Nokia was stealing technology from 13 Apple patents and attempting to obtain more money from Apple than other companies. Apple also charged that Nokia was also trying to obtain access to Apple's intellectual property with respect to the iPhone since Nokia had copied and is now using that technology.

Nokia has lost a tremendous amount of market share since the iPhone was released in 2007, and the company's profit margins are slim compared to those of Apple and BlackBerry manufacturer Research In Motion. The battle between Nokia and Apple is heating up, and it's only going to get more intense as Apple fights for more market share in the mobile phone world and Nokia tries to hold onto its former glory.

Are you people high?

Nokia BY FAR has the largest share of the global mobile handset market.

Apples share is a pimple on the buttcheek of said market. Apple has been knowingly infringing on Nokias many patents while they ramp up business and market share and settle later if they get away with it. It is a well-known strategy of Apple Inc...across many sectors. The thing is, Nokia is at the helm of this bobsled and has been for many moons.

I mean, have we really gotten so deep in to the mental stroking that we grab any figure out there, any story and dare not look below the surface?

The main questions now:

Does Nokia's complaint to the U.S. International Trade Commission (ITC) have any bearing on the already ongoing litigation. Which has priority? Do the two run side-by-side?

Does the ITC have any legal clout? If the courts decide in Apple's favour but the ITC favour Nokia's case, which takes precedent?

This will run for years unless there is an out-of-court settlement and Apple could be way ahead of Nokia by the time the dust settles. Nokia could even go out of business if it spends spends spends in the hope of recouping losses by suing Apple and losing. Nokia would be forced to withdraw its goodwill and start suing every phone and computer manufacturer on this planet....

Yea just like SIP said, Nokia wanted Apple to pay more to license the same patents that every other cell phone maker license. That really smells of desperation too.

Yup, the next 15 comments will be about how Nokia sucks because this is an APPLE blog.

In any case, in the technology business, it's not as black and white about licensing patents. It appears to be quite normal that companies will try to get away with not licensing if they can and will even bully each other by leveraging their own patents. There's really nothing abnormal about these lawsuits. It's just business. Look at Palm and Apple. There is a lot of patent infringement on both sides, but they having filed any lawsuits against each other. Nokia could just leave it alone, but I think the fact that they didn't shows they are getting desperate.

It is an Apple blog, which is why I don't expect logic. Just because I'm a Mac user doesn't mean that every Apple product is better than everything else out there. Apple has a long history of bullying other companies, both software and hardware.

Also, give a source that Nokia wants more from Apple than any other manufacturer, and make sure it shows that the number has to do with the exact technology that Nokia is licensing to other companies, and doesn't include other patents that Apple is infringing on. The only number I've seen is out of the lawsuit, where Nokia is claiming a number that's higher because it'll get negotiated away as soon as the actual litigation takes place.

Don't get me wrong, I think this is completely stupid, but to blindly say APPLE IS TEH R0X or NOKIA HAS TEH SUX is even worse.

Most of the GSM technology that Apple uses in the iPhone is also used by every other phone manufacturer. Nokia agreed to allow others to use this on a fixed "fair payment" basis.

The difference here is that Nokia wanted Apple to pay MORE than other manufacturers have to pay. Negotiations reached stalemate and that is when Nokia decided to sue Apple. Apple, in turn, (possibly rightly) countersued Nokia for infringing on Apple patents which are NOT covered by the "fair payment" agreement.

Nokia probably messed its pants and in a last ditch attempt has approached the U.S. International Trade Commission (ITC) probably in the hope that the ITC will force Apple to stop importing iPhones etc into the USA ONLY (similar to the Broadcomm case???).

Any ruling by the ITC prejudicial to Apple would mean that Apple would either have to stop selling iPhones in the USA or produce them locally (probably at double the price?). This ruling would not affect any other market, but as the US is the biggest outlet for Apple, it could dent Apple's profits.

Nokia is fighting a desperate battle, and has to stop losing market share and money -- around £17million last quarter?

Not sure what Nokia is worth but maybe Apple could buy them and just close shop. Transfer the employees to the app store so app approval process speeds up.

Or something like that.

Companies suing companies can be so silly.

Apple could easily swallow Nokia but it would be a damn expensive way to kill off Symbian which is now wholly-owned by Nokia.

They made two different touchscreen phones, but they just didn't have the power to stick. That being said, both sides are being idiots here. Apple knows that Nokia owns the IP for some of their work, but refused to license from Nokia. Nokia sues. Apple sues back for other crap. Nokia now throws more into the mix.

This will get settled out of court with a patent cross-license, but it's going to be ugly til it does.

On the other hand, this is TUAW, so the next 15 comments will be about how Nokia sucks and Apple rocks.
