AT&T out of stock on iPhone 3G, offers unlimited iPad data plans to those who order by June 7

It's a sure sign a new iPhone is coming. AT&T says it has no 3G models to sell, which may spell the end of the line for the previous-gen handset.

Also today, a company spokesman has told TUAW that it will honor the unlimited data plan on the iPad for people who order a 3G iPad by June 7 (even if it's not delivered by then), though officially AT&T has dropped the option for new customers. The unlimited option can only be maintained for accounts with auto-renew turned on, and if you drop your service for a month you can only sign back up for one of the new plans.

A lot of people who bought the iPad and were told they could get an unlimited monthly data service feel pretty abused about now. The words 'bait and switch' come to mind, as Macworld's Dan Frakes pointed out. It's particularly an issue for people who bought the iPad but have not initiated service as yet. After June 7, the unlimited option won't be something you can purchase. We've heard from at least one reader who was able to return his iPad 3G without a restocking fee when he cited the AT&T plan changes, but your mileage may vary.

Back to those 3G phones. AT&T is telling customers who want a 3G to get either a 16 or 32GB 3GS iPhone. When the expected new iPhone comes out later this month, it's likely the 3GS model will drop in price, probably to US$99.

Upgraded to unlimited plan last night and received a confirmation email from AT&T as such. This morning, my iPad had a message that the upgrade was unsuccessful and to try again, now the unlimited plan is not available, which I knew would be the case. Will see if they honor their email confirmation.

As an aside, my local Apple store is out of iPhones completely as well. Maybe new iPhones go on sale tomorrow? Hope so.

Okay, I've been reading all of the AT&T bashing for a few days without saying anything, but it's getting ridiculous. Seriously, look at the facts. Verizon Wireless is going to do the exact same thing (see the most recent article about this here: http://www.reuters.com/article/idUSTRE6536KL20100605?type=technologyNews), and they were actually the first ones to bring it up. Their CEO has been suggesting his company move towards this type of pricing arrangement for the last month.

Now, as for T-Mobile and Sprint, if they're smart, and they occasionally are, they should keep their unlimited plans to have any hope for survival. Time will tell. They obviously aren't facing the same bandwidth and network congestion issues the big guys are or soon will be facing.

For the new iPad 3G users, seriously, if you consistently use more than two gigs (when you are not on WiFi!) then keep your auto-renew turned on and chill out. If you don't, use your WiFi (way better for your battery life anyway) and enjoy the price cut in your service plan - it saves you $60 a year. Remember, AT&T is most likely going to roll out many, many new WiFi hotspots, in addition to the 20,000 they already have, this year as another way to battle its network congestion.

For me, I use my iPhone constantly. Constantly. When I saw this new release a couple of days ago, I thought to myself, thank goodness I have an unlimited plan I can keep! I must be one of their top data users! I stream movies, listen to Pandora, serve the web, and download apps constantly, everyday. It's just the way I am. Well, turns out, my average data usage from my bill is around 300 mb. 300! Less than one-sixth of what the new "DataPro" plan will offer me! I'll probably stick with my unlimited plan anyway, just to have it, but come on. Look at the facts before you flip out.

Oh, yeah. And use WiFi. I don't know about all of you, but here in Portland, Oregon, it's everywhere.

Well good for youuuuuuuu!

One of the major reasons a lot of us bought the iPad 3G was BECAUSE of the great unlimited plans. You can't sell somebody a $600-$800 gadget with promises of plan X for service, and then pull the rug out 2 months later. They promised no contract, turn of an on at your leisure, yada, yada, yada. It was a MAJOR selling point.

What AT&T (and Apple?) are doing is complete horseshit.

BTW, your take on the situation is a bit narcissistic. Not everyone has the ability to get wi-fi everywhere they turn, so while not a big deal to YOU... it might be to others.

AT&T backed off the Facebook post and claimed you have to be on auto-renew to keep the unlimited data plan. There will be litigation over this. Unfair and Deceptive Trade Practices allow the recovery of attorneys' fees and treble damages. I expect the first suit will be filed on Monday if it was not filed on Friday.

Or Steve is all about the Benjamins and announces a new extended contract with AT&T. That's right folks. We looked at the numbers and this is a better deal to sucker, I mean bring, in new customers that wanted an iPhone, but didn't want to spend $30 a month. It was actually our idea and Apple did the number crunching. This will allow more users with less bandwidth issues to use AT&T. And you'll believe me, because I'm Steve Jobs and I know what's best for you. This will make the wireless expierence much better.

Now honestly I love all my Apple products, but you know if Steve comes out and says anything like this people will forgive AT&T. You know after the backlash goes down Verizon will unveil a similar plan. Both reducing their prices to the same for family plans, same text costs, etc. They work together, but since there is other competition they won't be called out on it.

Why is Apple joining AT&T in their deception? The Apple store still says that we can have start/stop unlimited 3G

AT&T stuck it to Steve, and I suspect that Apple's lawyers have been using two words to AT&T's attorneys in the past few days: reliance and indemnity.

Reliance is contractual damage caused by relying on the promises of others. Steve did announce a breakthru deal. AT&T yanked it. Sorry, but Apple relied on the promises of AT&T to make that announcement. AT&T will have to pay the piper, on way or another.

Indemnity is the other clause as there's likely 50 million ways the Apple is indemnified by AT&T. Think of indemnity clauses as "stupid" insurance. They usually says things like "The parties agree that if Wireless Company does [something stupid], and Apple suffers damages caused by or arising out of that [something stupid], Wireless Carrier will indemnify and hold Apple harmless to third party claims.

Insert [revoke promised unlimited pricing without contracts] for something stupid above.

It's been discussed -- have no doubt about that. The question on AT&T's side is whether that is really why they offered it "without contract"... intending to do what they did now which is to impute a contract by forcing people to auto-renew. That's a deceptive practice at lease, and fraud at worst.

But who are we kidding here... ma bell would never defraud anyone.
