Apple suing Samsung: Galaxy too similar to iPhone look and feel
The Wall Street Journal is reporting that Apple has filed suit against Samsung, claiming that the Samsung Galaxy line too closely imitates the look and feel of the iPhone and iOS. The lawsuit specifically calls out Samsung's products, like the Galaxy S 4G, Epic 4G, Nexus S and Galaxy Tab, and goes on to state that, "Rather than innovate and develop its own technology and a unique Samsung style for its smart phone products and computer tablets, Samsung chose to copy Apple's technology, user interface and innovative style in these infringing products."
This specific lawsuit is a bit more awkward than usual as Apple is not only Samsung's competitor, but also one of its largest clients. Samsung currently supplies Apple with large quantities of flash memory, LCD displays and the A4 and A5 chips found in iPhone 4s and iPads. There's no word yet on what kind of damages Apple is seeking in the lawsuit, but given that the company is saying Samsung copied the look and feel of both iOS and iPhone and iPad hardware, it's not a stretch to assume that Apple would demand all devices be removed from the market should it win the suit.
UPDATE: Apple has issued the following statement to Mobilized: "It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging. This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas."

Apple Ltd. provoked in many aspects everything that we can see happens now. Reason ? It is simple. All people over the world would like to have Apple's products, but Apple never thing to do something more than to get a Higher price's & incomes focused only in One country and region - for all remaining parts of the world Apple offer Hight prices and no or no possible delivery at all. Considering that Apple produce her items in China it is strange that in all Europeans countries prices are much higher than in US. People are not stupid also they do not like to be discriminated - which Apple Do. There is nothing strange that Samsung win costumers everywhere - they do not discriminate People and their prices is lower than Apples prices.

I mean, maybe they actually were planning to release something that DID look eerily similar to the iPhone/iPad, so what? You should NOT be allowed to lock-down a particular well designed product such as the iDevices!?!
Right???

The breadth of this case, spanning utility patents, design patents, trade dress, and trademarks, is impressive. I think to a lay person, the design patent case might be the most compelling. It's easy to forget, but before the iPhone, no phone looked like the iPhone, and Apple would surely remind a jury of that fact.
I think with the CAFC's reiteration of the "ordinary observer" test, the design patent case looks fairly strong: http://www.applepatent.com/2011/04/apple-v-samsung-design-patents-egyptian.html

I won't pin any one over the appliance hardware and also i am calling off the blame against Samsung. The law suit would have been valid if Samsung was using apple's logo to market its products just like Nokia in Finland or Hungary and Nokia in China. let us look at the logo point of view rather than the software or hardware. Apple should know that this is very hard to avoid in the market. Please apple take heart.Tanzania Vacations

April 19 2011 at 12:10 AM Report abuse Permalink -1 rate up rate down ReplySo what part of this phone looks like an iPhone? Just because it has rounded corners and a shiny edge? Jeez. Come on Apple. They may be copying some of Apples ideas but stealing?

It kind of makes them look desperate.
Yes but the Original iPhone also copied the look of the LG Prada. And nobody said a word.
