AT&T to throttle speeds for some unlimited data users

AT&T announced today that it's throttling back the speed that the highest-usage unlimited data subscribers can use on the network.

Starting Oct. 1, these high-use customers could experience reduced speeds on AT&T network once they've hit a data limit for the month. They'll still be able to access data, but at a much slower speed. The company said that it would provide notices and a grace period before cutting back on the user's speed. It'll be restored to full strength at the beginning of the customer's next billing cycle.

AT&T says that this only affects 5 percent of the heavier data users on the service. These people use more than 12 times the rest of data users combined. As 9to5Mac reported, Verizon and Virgin have also adopted similar plans to deal with bandwidth hogs. While AT&T hasn't released its data threshold, 9to5Mac gives Virgin's, which is 256Kb/s once you've reached a 2.5 GB limit. It wouldn't be shocking to see AT&T have a similar limit. Most likely, the upper threshold will be around 4GB, which is the company's top-tier data plan at this time.

This is total BS! I purchased unlimited over three years ago for a reason. I do not know what they are comparing my 5% of data usage too because if you ask they will not give you an answer and are quick to just change the subject. I used less than 1,5 GB and was being throttled down at that point on a so called "Unlimited Data Pan." I am scouring the web looking for a class action suit to join in on. I will not drop my Unlimited plan because that is exactly what they want you to do and I was told that by a Care rep from AT&T. Lets ban together and fight this!!!

I'm experiencing the same issues as everyone has voiced below. I by no means am a "heavy data user". I'm furious they've slowed down my internet speed. AT&T says your speed increases at the beginning of your billing cycle? Yeah...for about 2 days! And now, to add insult to injury, after owning their USELESS Air, or Sim Card as it's called since Nov 2008, AT&T has just recently added a cap on how much usage we can use for free before we're charged!!! This plan has NEVER had this cap. Even more frustrating is the stupid thing buffers longer than dial-up so we spend more "usage" time buffering than browsing. I mentioned to one of their reps yesterday that I strongly believe this is AT&T's way of forcing customers to upgrade to their new phones, new service, and renewing contracts. I will be HAPPY to join in on a Class Action Suit!

I only used 2 gb of data and received a text that stated that I was in the top 5% of all users. Come on AT&T, you're not even being honest!! I called the number that was on the text and was told by a representative that for unlimited plans, this is considered being in the top 5%. Please....I used to use 10 gb of data a month. Now my phone is unusably slow.

When iphone 5 comes out I'm taking my money to Sprint.

I'm ready for the FIGHT. Class Action Lawsuit Pending? I called and had them note on my account that I will cancel my plan as a breach of contract on their part. I will not pay ANY fees. Please call 611 and have them log your discontent on your account. Thank You.

Well I received an email today about this tethering thing. I got an email and text a week or so ago about being at the top 5% of data users and that my service was going to be slowed until next billing cycle!!! I was on the phone over an hour with them and they told me it was just a warning that I should not use netflix on my iphone or use pandora. I DO NOT tether, heck I didn’t really know what that was until looking it up. I only use netflix while driving at times when my little one is fussy and just to quiet her down. Why are they trying to restrict what I look or listen to on my phone??!!! I am beyond upset! I called att and they told me to call 866-679-7118 and the rep told me this was notated on my account as an immediate alert:
Customer was notified of tethering and possible rate plan migration.
They better not switch me to a data plan without my authorization!!! I have had the unlimited data plan 3 years and this is so upsetting!!!

Where can I find info about a class action lawsuit....At&t needs to be stopped!! I am so upset over this...my phone has been super slow the past couple of months and I never knew why!!

It's unclear to me how ATT determines who is a top 5% user. Is it the top 5% among users with the same plan? If it isn't, all users with a 2 and 4MB limit will significantly bring down the average usage. Even if they are not included, limiting usage among users with the same plan will lessen overall usage thus perpetually lowering the average. Limiting the heaviest users bring down the overall average every billing cycle every cycle.

AT&T can't unilaterally change the terms of service contracts it made with its customers. I have an unlimited data plan with AT&T. When I signed up for the plan about 6 months ago, AT&T said it was unlimited. Unlimited means unlimited and they didn't say it would get slowed down after a certain point. They assured me it was truly unlimited both over the phone (calls which I recorded) and in every writing and piece of account information on the web. This is called a contract. They can't unilaterally back out of it now. Don't put up with this if you are in my shoes. This is sure to draw a class action suit for breach of contract, fraud, and unfair business practices. It is classic AT&T: nothing but lies, deception, misleading/confusing "information". They tell you one thing on the phone and then do another, never living up to their promises. When you call them on it, they tell you that you did not understand. I solved this problem by recording every call with them. DON'T PUT UP WITH IT IF YOU ARE AN AT&t CUSTOMER. Call them to the carpet on this one by calling them and letting them know that you know that they are breaching their contract with you if they throttle your data service after promising you unlimited data. My guess is that this will make them change their tune for customers who do this and screw all those who don't.

AT&T should build accelerating costs into their data plan structures and not artificial limits/throttling! Unlimited should be just that. Just because some users take more advantaged of the plan, they shouldn't be penalized. I myself have had unlimited since I got my first iPhone. Over time, I've found that my data consumption is growing every month as my use and dependency on the phone increases. AT&T you need decide if you want to offer unlimited or not!
