Apple's evidence in Samsung case might not match up

The Internet is abuzz with images from Apple's lawyers presented to a judge in Germany that show Samsung's Galaxy Tab allegedly distorted to better match the dimensions of the iPad. Of course, no one but Apple's lawyers, perhaps, know if the images submitted were intentionally doctored or if they were inaccurate for other reasons, but the inaccurate evidence isn't going to do Apple any favors in the German courts, even if it is an honest mistake.

Earlier this month a German court blocked Samsung from selling the Galaxy Tab 10.1 across most of the EU in response to an injunction Apple filed. Apple said that the Galaxy Tab 10.1 was a "slavish copy" of the iPad. You can use Photoshop these days to turn anything into a "slavish copy" of the original, but of course if the original comes to light, as it has here, there will undoubtedly be some backpedaling in action. It'll be interesting to see how the German court reacts to the inaccurate pictures, but no doubt Samsung has a smile on its face right now.

And a little bit of Photoshop shenanigans is not going to erase Samsung's CEO publicly stating that they made changes to the Galaxy Tab 10.1 after seeing the iPad 2

Nobady talks about the fact that what we are seeing in Samsung's tablet in the image above is the "Apps" section of the Honeycomb, not the natural homescreen, just as the Ipad is showing. They are comparing two different things, and usually users are in the main screens. If you compare the main screens of Ipad and Samsung tablet, they have absolutely nothing to do, specially because the Samsung tablet is naturally build to use it in landscape mode (I know, you can use it however you want, but a 10.1 screen tablet is usually used in ladscape). So I think that not only the size of the Samsung tablet is misleading, but also what Apple chose to put as background of the Samsung tablet. They are comparing apples with bananas. Of course, there might be other images that we don't know as people point out, but just wanted to make the point with this one image (if this happens once, for sure will happen in many images). And for the record, I am an apple guy...

Well that might be because Apple is making the case that the general design of the device and that samsung has made has made changes to the android app drawer to make it similar to the iPad homescreen (horizontal paging, they added a background to icons to make them all rectangular).

Gruber's an idiot. I'm an Apple guy, and I can even point out that all the other images don't help Apple's case. This is a prime example of Fanboy-ism that doesn't help anyone think realistically. Do they look EXACTLY the same? Hell no. Case closed. If you say they look the same, prove to me how. They don't have the same aspect ratio, but who cares about that. How's about the fact that the cameras position is on the wide end on the Tab? Button? I don't see a Home button anywhere. This is the REALITY, Apple see's Samsung as a threat. And rightfully so. They make damn good products, so this would be great for competition. That's what this is about. Just like Google buying Motorola, it's about patents. So tell Gruber to take his iDildo out of his ass and be a man.

i think it's interesting that Gruber made his argument in 64 words referencing the full complaint. Meanwhile it took you 145 words referring to conjecture.

If you read the complaint, you'd see that the section comparing the above image is discussing the interface elements and presentation... not the screen sizes. The pages that are concerned with the physical layout of the tablet has them pictured side by side...

But, why bother fact checking...

Are you kidding? The only reason there is a 'tablet market' is because of the iPad. Everyone is ripping off everyone else, it's just a matter of proving it. The iPhone's the same thing - the way the top smartphones look and work now are total rip-offs of the iPhone, and Tablets are mostly the same.

The patent system is just a big failure. Patents are granted on things that patents shouldn't be granted on, and Doctor'd image or not, Apple's litigious streak here is...regrettable. (but maybe it bought them enough time and iPad sales to offset the cost of the case...heh.)

It's really easy for the uninitiated (non geeks, lawyers and judges) to get hung up on the fact that the Tab's aspect ratio is different, and then fail to fully appreciate the similarities between the two devices. The fact that the tab has a different aspect ratio hardly matters when so many other aspects of the industrial and user experience design are so blatantly similar. Apple is trying to keep people from being distracted by something they've deemed unimportant in the case.

Perhaps Apple should have changed the iPad's screen ratio to that of the Tab. If so many people didn't know exactly what an iPad looks like, they probably would have.

It's really easy for the uninitiated (non-geeks, lawyers, and judges) to get hung up on vague physical similarities, and then fail to appreciate the fundamental differences between these two devices. The fact that they both come in black with rounded corners is nigh irrelevant when the screen size (the most important, central trait of the tablet) is strikingly dissimilar; the size, shape and weight are all different; and one noticingly completely lacks the essential button of the other.
