Samsung already planning legal action against iPhone 5

Samsung has announced that it will launch legal action against Apple the very instant the iPhone 5 steps foot in Korea, according to Korea Times. Specifically, the manufacturer will move to block sales of Apple's phone.

Quoting an unnamed source identified only as an anonymous Samsung senior executive, Korea Times notes that Samsung will "...take Apple to court here for its violation of Samsung's wireless technology related patents." Additionally, the Samsung source reiterated his/her company's dedication to its battle with Apple, saying, "For as long as Apple does not drop mobile telecommunications functions, it would be impossible for it to sell its i-branded products without using our patents. We will stick to a strong stance against Apple during the lingering legal fights."

This is the latest volley in the legal back-and-forth between these two tech giants. As of this writing, it looks like the battle has only begun.

I'm getting a bit sick of this. I've seen children behave better.

Surely, this suing and counter-suing will lead to stagnation as no one will bring new products out in case they get sued.

While I can easily think of innovative products Apple has brought out, I'm hard-pressed to see how Samsung has done the same.However, I am happy to be proven otherwise!

In my mind, Samsung's stock in trade is to bring out variants of other companies innovations, albeit often good products.

Samsung actually is fairly innovative on its own, taht's why the copyright issues are quite saddening. Their Super AMOLED display is brilliant, and depending on usage better than the Retina Display (I prefer the Retina display for its quality, but the AMOLED screens have better color and come in larger sizes). Samsung also has had a few milestones with their Hard Drive division, and I'm sure there is lots more "behind teh screens" stuff we don't really see.

If the patent contributes to establishing a standard without which it would be impossible to produce a communications device, then Samsung will have had to allow use of that tech at a fixed licence fee. This is like the Nokia case all over again.

If the patent has to do with how the Samsung chip has been produced and and Samsung's code has been embedded into that chip, then someone will have to cough up the licence fee.

What is interesting is that this case will only be filed in Korea, and if an injunction is granted in Samsung's favour, the demand for black-market iPhone 5s is going to go crazy -- in some countries where iPhone is not officially available, prices can be 1.5 to 2 times greater than RRP.

Samsung knows they vigorously copied the iPhone and iPad so now they are trying to use litigious patents to get back at them. Apple is buying these chips from samsung FYI so they should have sued from the beginning.

If the parts that are enabling the "patent" violations were bought by apple from Samsung then shouldn't that include use of the patents themselves by default? It seems pretty shoddy to sell someone a million phone parts and then turn around a year/years later and say "hey, you don;t have permission to use that functionality"

I think it's about parts in the iPhone 5 that we're NOT made by Samsung but other part suppliers. Which begs the question, is Apple they should be sueing or some of these other part suppliers.

It will be interesting to see their compolaint in full "when" the iPhone 5 is actually released. What happens if it's not the 5 but the 4s?
