Apple opposes Verizon's timing in Samsung case

Late last week, Verizon Wireless stepped into the heated battle between Apple and Samsung. The wireless carrier asked the federal court if it could file a brief in support of Samsung. In its brief. Verizon said an injection against Samsung would be harmful to US wireless customers and could stunt the growth of Verizon's 4G network. Apple responded to this filing on Tuesday and asked the court to either throw out the brief or allow Apple until October 6 to respond.
In its response, Apple does not address the validity of Verizon's claims. It's primary concern is the timing of the filing. Apple claims Verizon incorrectly filed the brief with the federal court instead of the appellate court and it filed it too late. According to the Apple, Verizon should have filed the brief by the end of August.

The only reason Verizon is "siding" with Samsung is because they just want as many devices to sell to consumers as possible. That's it. They don't care who wins so long as they get to sell more devices and make more money. But having Samsung products in addition to iPhone will surely allow them to sell more.

The demise could come in the next few years however but this is a clear sign that it has peaked.

September 28 2011 at 12:01 PM Report abuse Permalink +1 rate up rate down ReplyNo Aly, the reason Apple is vigorously fighting Samsung is due tot he fact that Samsung blatantly copied Apple's ID and trade dress...which is made even more shameful due to the fact that Apple was, until this mess started, Samsung's largest customer.
There are myriad ways to make a tablet computer without copying apple's exact dimensions in corner radii, thickness of bezels, spacing and proportions, aping the packaging, etc. Seriously. Ask Motorola...or ASUS...or RIM...or any of the other Major Players that you know, haven't done this.
Samsung made their case *worse* by actually introducing a non-infringing version of the Galaxy Tab 10, then upon seeing Apple's latest offerings, actually stating to the press that they were going to have to scrap and and re-design it, only to shop up at the next major overseas tradeshow with a new prototype that looked even *more* Apple-like.
This isn't at all about the straw man arguments about Apple trying to "own" the rectangle, prior art or any of this other nonsense. It is about Samsung doing to Apple what they used to do to Sony and a whole bunch of other Japanese and Euro CE companies...and Apple not taking it.
As for when AAPL "peaks"...we'll let you know. Seems like the evidence shows they are still going in one direction: up.
